In consideration of my being allowed to participate in Pole Parties, Lessons, Classes, Workshops and or to use its equipment, I agree to the following waiver and release.
I, for myself, my heirs, executors or anyone else who may claim on my behalf hereby waive, release and forever discharge “Pink Cherry Pole and Dance Studio, LLC”, it’s directors, officers, employees, representatives, party presenters, executors and all others (“the releases”) from any and all responsibilities or liability from personal injury, death, damage to property or loss of any kind resulting from participating in any programs or parties or by use of equipment belonging to or made available by Pink Cherry Pole and Dance Studio, LLC. Due to any cause whatsoever, including negligence, breach of contract or breach of any statutory or other duty of care, and also including the failure on the part of Pink Cherry Pole and Dance Studio and its employees to safeguard and/or protect me from the risks, dangers and hazards of participating in a party, class, lesson or any activity, I hold “Pink Cherry Pole and Dance Studio, LLC.” not responsible.
I acknowledge that I am attending a party, lesson, workshop and or class activity sponsored by “Pink Cherry Pole and Dance Studio, LLC.”. I understand that classes at our studio may be physically strenuous and I voluntarily participate in them with full knowledge that there is risk of personal injury, property loss or death. I agree that neither I, my heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against Pink Cherry Pole & Dance Studio or its staff, members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise. I freely accept and fully assume all such risks, dangers and hazards and the possibility of personal injury, death, property damage and loss resulting there from this such activity.
I acknowledge that Pink Cherry Pole & Dance Studio is in no way responsible for the safekeeping of my personal belongings while I attend class. Pink Cherry Pole and Dance Studio asks that you please leave your wallet, pocketbook, and/or big bag in car.
I acknowledge that “Pink Cherry Pole and Dance Studio, LLC” has the right to refuse me service if at any time any of their directors, employees, representatives or party presenters deems me unsafe to engage in any activity or use any of their equipment for any reason.
This agreement and any rights, duties and obligations as between the parties to this agreement shall be governed by and interpreted solely in the accordance with the laws of the State of North Carolina and no other jurisdiction and any litigation involving the parties to this agreement shall be brought solely within the State of North Carolina and shall be within the exclusive jurisdiction of the Courts of the State of North Carolina.
In entering this agreement, I am not relying on any oral or written representations or statements made by Pink Cherry Pole and Dance Studio, LLC other than what is set forth in this agreement.
I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS “RELEASE WAIVER” AND FULLY UNDERSTAND ITS MEANING AND CONTENT. I UNDERSTAND THAT I AM WAIVING ANY POTENTIAL RIGHTS WHICH I OR MY HEIRS, EXECUTORS AND REPRESENTATIVES MAY HAVE AGAINST “Pink Cherry Pole and Dance Studio, LLC” at 3682 Capital Blvd., Raleigh, NC 27604.
